Section 11 of the Homelessness etc (Scotland) Act 2003 places a duty on landlords and creditors to notify the relevant local authority when they raise proceedings for possession or serve certain other notices. Its purpose is to give local authorities early notice of households at risk of homelessness due to eviction or repossession. The duty under section 11 came into force on 1 April 2009.
We have developed procedures for receipt and processing of notices. Landlords or creditors can access the form here, Private Sector Section 11 notice (PDF 11Kb)
The Scottish Government and COSLA have worked with local authorities to produce an information sheet detailing where notifications should be sent throughout Scotland.
