Mauchline conservation area proposal

The Mauchline conservation area currently benefits from a Conservation Area Regeneration Scheme (CARS) which aims to protect and enhance Mauchline’s culture and heritage assets.

The Mauchline CARS was launched in October 2019 and involves the restoration of key historic buildings, urgent repairs on private traditional properties, shopfront improvements, and public realm works, among other actions. These developments are already having a positive impact on the appearance of this historic town.

We believe in the importance of protecting these improvements, and to this end are considering the use of further legislative powers in the Conservation Area. Presently, certain classes of developments and alterations can be carried out without the need to apply for planning permission, known as “permitted development”. Classes of development may be removed from permitted development, subject to the approval of the Scottish Ministers, under Article 4 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (as amended).

Similarly, there are several classes of advertisements which can be displayed without the need to apply for advertisement consent under the Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984, known as “deemed advertisement consent”. Regulation 11 of the latter provides that, subject to the Scottish Ministers approval, these classes may be removed from deemed advertisement consent.

We are seeking your views on the introduction of an Article 4 Direction and the Removal of Deemed Advertisement Consent for the Mauchline Conservation Area. The effect of the proposals would be to extend the classes of development and advertisement that would be required to apply for consent as set out in the proposal documents below.

Any planning permission or advertisement consent fee would be waived, where the need for consent arises solely from the operation of the Article 4 Direction or the Removal of Deemed Advertisement Consent.
