A raised structure means any platform, stand, staging or similar structure providing seating or standing accommodation which is 600mm or more above surrounding ground/floor level.

Examples include:

  • temporary grandstand
  • temporary seating at golf
  • bowling
  • circus
  • pop concerts
  • hall staging
  • boxing

Permission to use a raised structure

Any person who uses or permits the use of a raised structure or structures for the purpose of providing for themselves, or others, raised accommodation requires the approval of East Ayrshire Council under Section 89 of the Civic Government (Scotland) Act 1982.

The application process

Applicants must provide the following:

  1. A completed application for the erection and use of a raised structure form S89-1 (PDF 120 KB) accompanied by comprehensive details, plans and the appropriate fee to 'East Ayrshire Council' within the time specified.
  2. A design certificate for the erection of a raised structure form S89-2 (PDF 84 KB) – signed by a Full Member of the Institute of Civil Engineers or the Institute of Structural Engineers will also normally be required to accompany the application.

We will review the application and request any further information and drawings from the applicant considered necessary. As part of the statutory application process the we will consult Scottish Fire and Rescue Service and other relevant bodies.

Once we are satisfied that the proposals are acceptable a Permission to Erect a temporary Raised Structure (Form S89-3) will be issued to the applicant.

Please note: permission to erect does not grant permission to use.

Building Standards would welcome early discussion with the applicant to assist in determining whether Section 89 permission is required and the most appropriate route to obtaining consent.

Construction and inspection of raised structure

Following construction of the raised structure a  certificate of completion of erection and inspection of a raised structure form S89-4 (PDF 117 KB) signed by a Full Member of the Institution of Civil Engineers or the Institution of Structural Engineers must be submitted.

Normally 24 hours notice will be given to our Building Standards Service that a raised structure has been constructed and is ready for inspection. Following a successful inspection Consent to Use a Raised Structure (Form S89-5) will be issued to the applicant. It should be noted that this permission is not valid until all the conditions contained in the schedule are complied with.

A simplified application process may be appropriate dependant upon the size and complexity of the proposed raised structure. For example, a stage comprising preformed modular units which simply bolt together would be considered a non complex structure.

Consent to erect and use such a raised structure could be obtained by submitting the application for the erection and use of a raised structure form S89-1 (PDF 120 KB) along with the appropriate fee and allowing Building Standards to approve the completed structure prior to use.

It is in the public interest that we must process your application before it can be granted.

Building Standards will require a minimum 14 day lead in period to process small applications of low complexity and a longer lead in time for the larger or more complex applications.
