Proposal
The Licensing (Scotland) Act 2005 requires all Licensing Boards to publish a Statement of Licensing Policy setting out how it will exercise its functions.
East Ayrshire Licensing Board is now consulting on the terms of its revised Statement of Policy.
In terms of Section 7 of the Act, the Board are required to include a statement as to the extent that the Board considers there to be over provision of licensed premises or licensed premises of a particular description in any locality within the Board’s area.
On the basis of the information provided by various local agencies and having regard to the Board’s own knowledge, the Board determined that the locality for the purposes of over provision is East Ayrshire as a whole and that there is an overprovision of off-sales premises only within the locality.
