East Ayrshire Council has the legal responsibility for Energy Performance Certificates (EPCs) under the following acts:
- Housing (Scotland) Act 2006
- Energy Performance of Buildings (Scotland) Regulations 2008
- Building (Scotland) Act 2003
Operational: Local authority owned buildings
Housing Services and Legal Services are responsible for:
- housing re-lets (new rental contracts)
- house sales seller’s pack
Facilities and Property Management Service are responsible for:
- new rental contracts and property sales for non-housing property
- building warrants for new buildings
- producing and displaying EPCs for public buildings
Enforcement: Local authority and privately owned buildings
Trading Standards are responsible for:
- housing re-lets (new rental contracts)
- house sales seller’s pack
Building Standards are responsible for:
- new rental contracts and property sales for non-housing property
- building warrant for new buildings
- display of EPCs in sale or rented buildings and public buildings
Additional legislation

- a register for recording EPC information for new buildings
- issuing enforcement notices on Building Standards Register
The Head of Legal Services and Democratic Services are responsible for:
- reviewing enforcement actions
- scheme of delegation
