Law and Licensing
The Legal Section of East Ayrshire Council is based within the Council Headquarters, London Road, Kilmarnock, and provides a comprehensive legal service to the Council.
The Legal Section consists of the following teams:
Litigation
The Litigation Team acts for the Council in all Court proceedings including ordinary and summary cause actions, licensing appeals, adoption and child protection proceedings, placing requests, anti social behaviour orders, recovery of possession actions, judicial review and interdict proceedings. Represents the Council at Employment and other Tribunals, acts for the Council in planning appeals and related enquiries, provides advice and legal support to all Committees and Officers of the Council. This section also includes the Debt Recovery team, who undertake most of the work in respect of recovery of rent arrears/evictions and the collection of all forms of debt due to the Council.
Conveyancing
The Conveyancing Team deals with Conveyancing related work including purchase and sale of land and buildings, title enquiries relative to ownership of land and maintenance responsibilities, preparation of Improvement/Repair Grant notices, preparation of and discharge of Charging Orders, provision of advice to Members, Committees and client Departments. This section also includes the Council House Sales team, who undertake the conveyancing work involved in the sale of Council houses.
Contracts/Economic Development
The Contracts/Economic Development Team deals with Contract and Economic Development related work including the processing of business loans and grants, conclusion of leases, the provision of advice on contract terms and conditions, European Procurement Law, PFI's and private/public sector partnerships as may be required.
Procurement
The Procurement Section is a dedicated "tendering" service available to all Departments, with all types of works, supplies and service contracts being a full-time basis.
Licensing
The Licensing Team deals with Administration of applications submitted under the Licensing (Scotland) Act, 1976, the Gaming Act 1968 and the Betting, Gaming & Lotteries Act, 1963.
District Court
Administration of District Courts at Kilmarnock and Cumnock. Collection of payment of fines, conditional offers and fixed penalties.
Records are held within the District Court Section of contact names and numbers of Justices of the Peace, to carry out bench serving and signing duties.
