East Ayrshire Licensing Board considers applications submitted for the licensing of:
Public Houses; Hotels; Restricted Hotels; Restaurants; Refreshment Premises; Entertainment Premises (eg discos); and Off-Sales.
Licensing Boards must hold meetings in January, March, June and October of each year and applications to be considered at each meeting should be lodged with the Clerk to the Licensing Board no later than five weeks prior to the meeting at which the application is to be considered.
Applications for Renewal of existing licences, Transfer of Licences, Children's Certificates, Entertainment Bye-Law Consents and Regular Extension of Permitted Hours are also considered at the Quarterly Meetings of the Board.
The following applications are dealt with by the Clerk to the Licensing Board under delegated powers and do not require to be submitted for a Quarterly Board Meeting:
Section 35 Consent for alterations; Temporary Transfer of Licence; Substitution of Employee; Gaming Machine Permits; Occasional Licences, Extensions and Permissions.
The Board also consider applications under the Betting, Gaming and Lotteries Act 1963 and the Gaming Act 1968.
Disability Equality Scheme
In terms of the Disability Discrimination Act 1995 (as amended) and the Disability Discrimination (Public Authorities) (Statutory Duties) (Scotland) Regulations 2005 the Board has been placed under a specific duty to prepare and publish a Disability Equality Scheme. The Board is in the process of revising it’s initially approved scheme and intends to be in a position to consider the revised scheme at the quarterly meeting on 12 June 2007.
In terms of the legislation the Board has been placed under a general duty when carrying out its functions to have due regard to the need to:-
1. eliminate discrimination that is unlawful under the Act;
2. eliminate harassment of disabled persons that is related to their disabilities;
3. promote equality of opportunity between disabled persons and other persons;
4. take steps to take account of disabled persons’ disabilities, even where that involves treating disabled persons more favourably than other persons;
5. promote positive attitudes towards disabled persons, and
6. encourage participation by disabled persons in public life.
The Board’s functions derive mainly from statute and are detailed below. The list is not exhaustive, but it does identify the key areas in which the Board operates.
The Board considers applications for the grant and renewal of:
1. liquor licences in terms of the Licensing (Scotland) Act 1976 as amended;
2. gaming licences in terms of the Gaming Act 1968 as amended;
3. gaming machine permits in terms of schedule 9 of the Gaming Act 1968 as amended and
4. betting office licences, betting agency permits and bookmakers permits in terms of the Betting, Gaming and Lotteries Act 1963
