Items for consideration may include the use of character references, ability,
age, experience, health, linguistic skills, misconduct, spent convictions
and multiple licences.
Suitable Location
Items for consideration may include structure, layout, physical condition,
suitability for a particular locality, potential effect on amenity and
the likely clientele.
Public Nuisance
The term ‘public’ includes those who are likely to be affected
by the conduct of the premises, as well as the customers. This is particularly
used on applications for renewal, where premises have established a ‘track
record’. When dealing with an application for a new licence it may
only be used with the presentation of factual material, rather than the
speculation that, it could cause problems.
Over Provision
Items for consideration are the number of licensed premises in the locality
at the time of the application and the number of provisional grant of
licences. There is no statutory definition of ‘locality’ although
it has been suggested that this involves some sense of identity of a community
which is not necessarily confined to physical boundaries. Comparisons
may be drawn between different types of licences for example or, the services
they may provide.
